M:Metrics Wins Summary Judgment Dismissing Patent Infringement Claim by Telephia

SEATTLE, WA -- (MARKET WIRE) -- 11/12/07 -- In a patent infringement lawsuit filed by Telephia, now called Nielsen Mobile, the court has ruled that M:Metrics does not infringe Telephia's patent. In awarding M:Metrics' petition for partial summary judgment, the court ruled that Telephia's claims "have been proven by M:Metrics to be either factually baseless or so highly attenuated that they fail to raise any issue of material fact." "All along this was a meritless suit, and I am pleased that the court concurs," said Will Hodgman, CEO, M:Metrics. "I am thrilled that the company has managed to remain undistracted by this nuisance suit, and has built the best mobile media measurement service in the world." MeterDirect, the first syndicated mobile audience measurement service using metering technology, was launched in March of this year. In June 2006, Telephia sued M:Metrics, alleging that M:Metrics' M:Meter platform infringed on Telephia's '011 patent entitled "System and Method for Measuring Wireless Device and Usage Performance Metrics." Undeterred by the lawsuit, M:Metrics has continued to build out its M:Meter platform, doubling its panel size in the United States and the United Kingdom, as well as expanding the breadth of platform support.
